Introduction, Enrolment, Course Access & Payment Options

Welcome to NZ Nail Academy. We are delighted to be part of your learning journey.

These Terms & Conditions govern the purchase and use of all online courses, digital learning programmes and pathway programmes offered through the NZ Nail Academy Online Academy.

By enrolling in any online course or programme, you acknowledge that you have read, understood and agree to these Terms & Conditions.

1. About NZ Nail Academy

NZ Nail Academy provides professional online nail education designed to help students develop practical skills, confidence and knowledge through structured learning.

Our online courses are self-paced unless otherwise stated and are intended to provide education and guidance only.

2. Enrolment

Your enrolment is confirmed once:

• Payment has been successfully processed, or
• A Study Now, Pay Weekly payment plan has been approved and established (where applicable).

Once your enrolment has been confirmed, you will receive access instructions via email.

It is your responsibility to provide accurate contact information and ensure your email address is current.

3. Eligibility

Students must be at least 16 years of age to enrol in our online courses unless written permission has been provided by a parent or legal guardian.

Students are responsible for ensuring they have the time, equipment and internet access required to complete their chosen course.

4. Online Course Access

Individual online courses include 12 months of access from the date of enrolment unless otherwise stated on the course sales page.

During your access period you may:

• Learn at your own pace.
• Watch lessons as many times as required.
• Download any course resources specifically provided for student use.
• Submit assessments where applicable.
• Contact our educator support team for assistance.

Course access is provided to the enrolled student only and must not be shared with any other person.

5. Learning Pathway Programmes

Selected pathway programmes may be delivered using a structured learning schedule.

Where applicable:

• Modules may be released progressively throughout your programme.
• Students will receive access to new lessons according to the published learning schedule.
• This structured approach has been designed to support effective learning and help students build confidence step by step.

6. Payment Options

Payment options vary depending on the course or programme selected.

Available payment methods may include:

Pay in Full

Students may pay the full course fee at the time of enrolment.

Where advertised, paying in full may provide the best overall value.

Afterpay

Eligible individual online courses may be purchased using Afterpay.

Afterpay is provided by a third-party payment provider and is subject to their approval process, terms and conditions.

Repayment schedules are determined by Afterpay.

Study Now, Pay Weekly

Selected pathway programmes may be available through our Study Now, Pay Weekly payment option.

This payment option is designed to make professional education more accessible by allowing students to spread the cost of their programme over fixed weekly instalments.

Study Now, Pay Weekly is currently available only on selected pathway programmes.

7. Study Now, Pay Weekly Terms

Where a student selects the Study Now, Pay Weekly option, the following conditions apply:

• Weekly payments are processed through our approved payment provider.
• Students agree to complete all scheduled payments associated with their enrolment.
• Students may pay the remaining balance in full at any time without penalty.
• Course modules may be released progressively throughout the payment period.
• NZ Nail Academy reserves the right to temporarily pause access to future course content if scheduled payments become overdue.
• Course access will normally be restored once outstanding payments have been resolved.
• Certificates of Completion will only be issued once all course requirements have been successfully completed and all payments have been received.

8. Student Success Kits

Student Success Kits are optional purchases and are sold separately unless specifically stated otherwise.

The purchase of a Student Success Kit is not required to enrol in an online course unless clearly specified.

Where students choose to purchase a kit, separate product terms, shipping policies and warranty conditions apply.

9. Pricing

All course prices are displayed in New Zealand Dollars (NZD) unless otherwise stated.

NZ Nail Academy reserves the right to change course pricing, promotional offers or discounts at any time.

Price changes will not affect students who have already completed their enrolment.

Discount codes cannot be applied retrospectively after an order has been completed unless required by law.

10. Payment Security

Payments are processed securely using trusted third-party payment providers.

NZ Nail Academy does not store your payment card information.

Students are responsible for ensuring payment details remain current where recurring payment arrangements apply.

 

Refunds, Transfers, Student Responsibilities, Assessments & Intellectual Property

 

11. Refunds & Cancellations

NZ Nail Academy is committed to providing high-quality online education and encourages students to carefully review the course information before enrolling.

Due to the digital nature of our online courses, immediate access to course materials is generally provided once enrolment has been completed.

Individual Online Courses

Once access has been granted to an online course, refunds are generally not available simply because:

• You have changed your mind.
• Your personal circumstances have changed.
• You no longer have time to complete the course.
• You decide the course is no longer suitable after accessing the course materials.

Where required under New Zealand consumer law, students will continue to receive any rights and remedies that cannot legally be excluded.

Pathway Programmes

Students enrolled under a Study Now, Pay Weekly payment plan are committing to purchase the selected programme.

Choosing not to continue studying does not automatically cancel the payment agreement.

Should a student wish to withdraw from a pathway programme, any remaining financial obligations will be assessed in accordance with the agreed payment terms and applicable law.

Course Cancellation by NZ Nail Academy

In the unlikely event that NZ Nail Academy cancels a course before access has been provided, students will be offered either:

• A full refund; or
• A transfer to an alternative course of equal value.

12. Course Transfers

Individual online course enrolments are generally non-transferable.

Requests to transfer to another online course may be considered at the discretion of NZ Nail Academy where:

• the request is made before significant course progress has occurred; and
• access has not been substantially used.

Administration fees may apply where course transfers are approved.

13. Student Responsibilities

Students agree to:

• Complete all work honestly.
• Submit their own assessments.
• Treat educators and other students respectfully.
• Maintain professional behaviour within the Online Academy and any private student communities.
• Use course resources for their own personal learning only.

Students must not:

• Share their login details.
• Give another person access to their course.
• Copy, reproduce or distribute course content.
• Record videos or download lessons unless specifically permitted.
• Resell, reproduce or teach NZ Nail Academy course materials without written permission.

Failure to comply with these conditions may result in suspension or termination of course access without refund, where appropriate.

14. Student Support

NZ Nail Academy is committed to supporting students throughout their learning journey.

Support may include:

• Email support.
• Course guidance.
• Assessment feedback.
• Access to the private student community (where applicable).

Support does not include unlimited one-to-one business coaching or personalised mentoring unless specifically included within the purchased programme.

15. Assessments

Some courses require practical assessments before a Certificate of Completion can be issued.

Assessment requirements are outlined within each individual course.

Students are responsible for:

• Uploading clear assessment photographs or videos.
• Following the assessment instructions provided.
• Completing work independently.

Where an assessment does not yet meet the required standard, constructive feedback will be provided and students may be invited to resubmit their work.

16. Certificates

Certificates are issued only after:

• All required learning modules have been completed.
• Any required assessments have been successfully passed.
• All course fees or payment plan obligations have been paid in full.

Certificates remain the property of NZ Nail Academy until all financial obligations have been satisfied.

17. Student Community

Students who receive access to the NZ Nail Academy private online community agree to:

• Treat other students with kindness and respect.
• Avoid offensive, abusive or discriminatory behaviour.
• Refrain from posting spam or promotional material.
• Respect the privacy of other students.

NZ Nail Academy reserves the right to remove any student from the community where behaviour is considered inappropriate.

Removal from the community does not automatically affect access to purchased courses unless there has been a serious breach of these Terms & Conditions.

18. Intellectual Property

All online course content remains the intellectual property of NZ Nail Academy unless otherwise stated.

This includes, but is not limited to:

• Training videos
• Course manuals
• Workbooks
• Downloadable resources
• Assessment materials
• Graphics
• Course presentations
• Photographs
• Branding
• Logos
• Teaching methods and educational resources

Students are granted a personal, non-transferable licence to use these materials solely for their own learning.

Students may not reproduce, distribute, copy, modify, publish, sell or commercially exploit any NZ Nail Academy content without prior written permission.

Unauthorised sharing or distribution of course materials may result in immediate termination of access and further action where appropriate.

19. Copyright

All copyright remains with NZ Nail Academy.

Students may download or print course resources only where specifically provided for educational use.

No part of any course may be reproduced or transmitted in any form without prior written consent from NZ Nail Academy.

 

Privacy, Artificial Intelligence, Student Work, Liability & General Terms

20. Artificial Intelligence (AI)

NZ Nail Academy is committed to ensuring that every certificate awarded reflects a student's own knowledge, practical skills and understanding.

Unless expressly authorised by NZ Nail Academy, students must not use Artificial Intelligence (AI) tools, including but not limited to ChatGPT, Gemini, Claude, Copilot or similar technologies, to complete:

• Written assignments
• Workbook questions
• Assessments
• Reflection activities
• Theory quizzes
• Any work submitted for marking

All submitted work must be the student's own original work.

Students found submitting AI-generated work may:

• Be required to resubmit the assessment.
• Receive additional assessment requirements.
• Have assessment results withheld while the work is reviewed.
• Have their course or certificate suspended where academic misconduct is confirmed.

NZ Nail Academy reserves the right to request additional evidence that submitted work is the student's own.

21. Student Photography & Marketing Permission

Students retain ownership of the photographs they submit.

By submitting assessment photographs or testimonials, students grant NZ Nail Academy permission to review and assess their work.

From time to time, NZ Nail Academy may request permission to feature student work, testimonials or success stories on:

• The NZ Nail Academy website
• Social media platforms
• Marketing materials
• Course promotions

Student work will never be used for marketing purposes without the student's permission.

Students may withdraw this permission at any time by contacting NZ Nail Academy in writing.

22. Privacy

NZ Nail Academy respects your privacy and is committed to protecting your personal information.

Information collected during enrolment may include:

• Name
• Email address
• Phone number
• Billing information
• Course progress
• Assessment submissions

This information is used only for purposes including:

• Managing your enrolment
• Providing student support
• Processing payments
• Issuing certificates
• Improving our courses
• Meeting legal obligations

Personal information will not be sold to third parties.

Where third-party providers are used (such as payment processors or learning platforms), information may be shared only as necessary to deliver our services.

23. Technical Requirements

Students are responsible for ensuring they have:

• A reliable internet connection
• A suitable computer, tablet or mobile device
• An up-to-date web browser
• Access to a valid email address

NZ Nail Academy is not responsible for issues arising from a student's own internet connection, computer equipment or software.

24. Disclaimer

Our online courses are provided for educational purposes.

Success within the nail industry depends on many factors, including personal commitment, practice, experience, business skills and local market conditions.

While NZ Nail Academy is committed to providing high-quality education, we cannot guarantee:

• Employment
• Business success
• Income
• Client numbers
• Examination results beyond our own course assessments

Individual results will vary.

25. Limitation of Liability

To the maximum extent permitted by law, NZ Nail Academy will not be liable for indirect or consequential loss arising from the use of our online courses or website.

Nothing within these Terms & Conditions limits or excludes any rights that cannot legally be excluded under applicable consumer protection legislation.

26. Website Availability

While every effort is made to ensure uninterrupted access to our Online Academy, occasional interruptions may occur due to:

• System maintenance
• Software updates
• Internet outages
• Technical issues outside our control

NZ Nail Academy will make reasonable efforts to restore access as quickly as possible.

27. Changes to Courses

NZ Nail Academy continually updates and improves course content.

We reserve the right to:

• Update lessons
• Improve resources
• Add bonus content
• Replace or improve downloadable materials
• Correct errors

These updates are intended to improve the student learning experience.

28. Changes to These Terms & Conditions

NZ Nail Academy may update these Terms & Conditions from time to time.

The latest version will always be available on our website.

Continued use of our Online Academy after updated Terms & Conditions have been published constitutes acceptance of those changes, where permitted by law.

29. Governing Law

These Terms & Conditions are governed by the laws of New Zealand.

Any disputes arising in relation to these Terms & Conditions will be subject to the jurisdiction of the New Zealand courts.
